Service Benchmark

These Terms constitute a supplementary extended warranty service agreement to Speediance's Original Manufacturer Limited Warranty Policy. For the exclusive value-added rights and interests under the Care Plan, these Terms shall prevail. For general provisions on hardware warranty scope and exclusions, in the event of any inconsistency or ambiguity between these Terms and the Speediance Original Manufacturer Limited Warranty Policy, the Original Manufacturer Limited Warranty Policy shall prevail. The after-sales maintenance service standards during the extended warranty period are exactly the same as those under the original 2-year base manufacturer warranty.
These service terms and conditions constitute a legally binding service contract between Speediance and the User, and are strictly governed by the federal laws of Canada and the laws of the province where your Device was originally purchased. By completing the purchase, activation of the Speediance Care product, or using any of the service rights and interests, you are deemed to have fully read, understood and unconditionally accepted all the contents of these Terms and the Speediance Original Manufacturer Limited Warranty Policy.

1. Definition of Key Terms

All terms herein are defined in accordance with the general standards of the extended warranty service industry in Canada, combined with the business rules of Speediance Care, as follows:
  1. Care Service / this Plan / these Terms: refers to the Speediance Care service product you purchased, including two editions: Speediance 3-Year Care (3-year Edition) and Speediance 4-Year Care (4-year Edition). The specific service content is subject to the provisions of these Terms; this Care Plan constitutes a service contract, not an insurance policy.
  2. Original Manufacturer’s Base Warranty Period: refers to the 2-year limited hardware warranty period provided with the Device, calculated from 00:00 on the date of delivery and signature of the Device. The specific rules are subject to the Speediance Original Manufacturer Limited Warranty Policy.
  3. Extended Warranty Period: refers to the period during which Speediance provides extended warranty service for core components after the expiration of the Original Manufacturer’s Base Warranty Period. The Extended Warranty Period is 12 months for the Speediance 3-Year Care (3-year Edition) and 24 months for the Speediance 4-Year Care (4-year Edition).
  4. Total Coverage Period: refers to the total duration of the Original Manufacturer’s Base Warranty Period of the Device plus the Extended Warranty Period of the Care Service
    1. Speediance 3-Year Care: Duration: 36 months total; Effective Date: Device receipt date; Expiry Date: 11:59 PM local time on the day immediately preceding the 36-month anniversary of the Machine Delivery Date
    2. Speediance 4-Year Care: Duration: 48 months total; Effective Date: Device receipt date; Expiry Date: 11:59 PM local time on the day immediately preceding the 48-month anniversary of the Machine Delivery Date
  5. Device Host SN Code / Serial Number: refers to the product serial number on the Device host body, which is the core credential for Care Service binding, rights verification, and identity authentication.
  6. Official After-sales Support Center: refers to Speediance's official remote technical team and designated cooperative logistics fulfillment centers, providing remote diagnostic and spare parts/replacement delivery services.
  7. Administrator: refers to the entity responsible for the sales, rights management, and service request processing of this Plan, namely Speediance Inc. All maintenance services must be pre-authorized by the Administrator before execution.
  8. Original Purchaser / You / User: refers to the user who purchased the Device through Speediance Canada's official Direct-to-Consumer (DTC) website and Amazon Canada, and is the sole legal holder of the rights and interests under this Service.
  9. Plan Price: refers to the full amount you paid for the purchase of the Care Service, subject to the order confirmation voucher.
  10. Order Confirmation Voucher: refers to the order invoice, receipt or confirmation email sent to you by Speediance after you purchase the Care Service, which records the core information such as the coverage period, edition type, and Plan Price of this Plan.
  11. Pre-existing Condition: refers to the failure, damage, or latent defect of the Device that already existed before you purchased the Care Service, including failures that have been reported but not addressed during the Original Manufacturer’s Base Warranty Period.
  12. One-Time Free Whole Device Replacement Service: refers to 1 free whole device replacement service provided by Speediance to the user when the agreed conditions are met within the Total Coverage Period, with full coverage of two-way standard logistics costs and no hidden fees.
  13. Remote Areas: refers to Yukon, Northwest Territories, Nunavut, and specific postal code areas in Canada requiring special air or sea freight delivery.

2. Service Editions and Coverage Period

2.1 Product Rights and Specifications

Speediance Care provides plan options for different Speediance models in the Canadian market. In addition to core component extended warranty coverage, each model includes matching exclusive value-added benefits as follows:

2.2 Special Provisions for Officially Certified Refurbished Devices

Officially certified refurbished devices are eligible to purchase the Care Service only within their original manufacturer warranty period (calculated from 00:00 on the date of delivery to the user). The coverage scope, service standards, and value-added benefits of the Care Service are identical to those for brand-new devices. Minor cosmetic defects on refurbished devices (such as light scratches, chipped paint, or wear that do not affect device functionality) are excluded from Care Service coverage.

3. Purchase Eligibility and Effective Rules

Care Services must be activated on the Device end to take effect and display benefits. Enter the order number (obtained via email or the official website) on the machine screen to activate 5 core Care benefits. (Path: Profile → Speediance Care → Activate Care)
  1. Basic Purchase Eligibility: The purchase of Care Services is exclusively restricted to the Original Purchaser during the Device's original 2-year base manufacturer warranty period. After the Device's original base warranty expires, the eligibility to purchase Care Services shall be permanently closed.
  2. Device Status Requirement: At the time of purchasing Care Services, the Device must be in normal working condition (fully functional and free of unresolved functional faults or physical damage). The Device shall be free of unauthorized disassembly, uncertified repairs, liquid damage, or physical impact. A Device that previously experienced malfunctions during the base warranty period remains eligible, provided such malfunctions have been fully repaired to original factory standards via official warranty channels.
  3. Binding Rules: A strict policy of one Care Service plan per Device Serial Number (SN Code) for the life of the Device shall be enforced. Repeated purchases or stacking of benefits are strictly prohibited. For the avoidance of doubt, a Speediance 3-Year Care plan cannot be upgraded to a Speediance 4-Year Care plan.
  4. Non-transferability Rule: This Care Service is strictly bound to both the Device SN Code and the Original Purchaser’s user ID, and is non-transferable, non-assignable, and non-divisible. It may not be transferred in connection with any second-hand sale, gift, lease, or other disposition of the Device, which is fully consistent with the non-transferability of the original manufacturer base warranty. Upon any change in ownership of the Device, all associated Care Service benefits shall automatically terminate, and no services shall be provided to any subsequent owner. Statutory warranties of the Device are not restricted by this clause; if you reside in the Province of Quebec, relevant matters shall be governed in accordance with the statutory provisions of local consumer protection laws.
  5. Purchase Channels: This Care Service may only be purchased through Speediance Canada's official DTC website. For Care Services purchased through unauthorized or unofficial channels, Speediance reserves the right to refuse service and shall bear no refund or performance liability.
  6. No Global Warranty Rule: Performance of this Care Service is strictly limited to the territory of Canada. No international or global warranty services are provided hereunder. For any repairs requested or conducted outside Canada, the user shall be solely responsible for all associated costs, including but not limited to tariffs, customs clearance, transportation, and warehousing expenses, in full alignment with the original manufacturer base warranty policy.

4. Core Service Rights and Interests

4.1 Core Component Extended Warranty Service

Adapts to the entire Speediance Gym series. During the coverage period, repair standards identical to the base warranty are provided for functional failures caused by material or manufacturing quality defects in core components (motors, driver boards, screens, mainboards, pulleys, casters, pedals, brackets).
  1. Exclusions (covered only by the base warranty): Rowing machine, flat bench, adjustable bench, Bluetooth ring, barbell hooks, barbell shoulder pad, adjustable barbell, rowing handle, ankle straps, triceps rope, general handles, ski handles, smart handles, yoga mat, weightlifting belt, extension straps, accessory storage rack, ball joints, resistance band kit, and Gym Nano battery.

4.2 One-Time Free Full-Unit Replacement Service

Within the Total Coverage Period, the user is entitled to one (1) free full-unit replacement service, with two-way standard logistics costs fully borne by Speediance. This one-time free replacement service is applicable exclusively to mechanical or electrical failures.
4.2.1 Applicable Trigger Conditions (Effective upon meeting any condition)
  1. Unrepairable Device Failure: Complex functional failures that cannot be resolved after official remote diagnosis and spare parts replacement, requiring an in-depth overhaul of the whole unit;
  2. High-Value Core Component Failure: Simultaneous damage to multiple core components where the total repair cost is severely disproportionate to the value of the Device itself.
4.2.2 Inapplicable and Excluded Circumstances
  1. Minor failures that can be effectively resolved through remote technical guidance or standard parts replacement will not trigger the replacement benefit;
  2. Full-unit replacement eligibility must be professionally inspected, reviewed, and officially confirmed by Speediance authorized service engineers;
  3. Damage resulting from user-inflicted damage, unauthorized disassembly or repair, uncertified modification, third-party maintenance, commercial use, overload/abuse, or force majeure events shall not be eligible for replacement service.
4.2.3 Device Replacement Rules
  1. Speediance may replace your Device with a unit of identical specifications and normal operating condition. The replacement unit may be a new device or a certified refurbished unit that meets manufacturer standards and equivalent quality;
  2. The functional specifications and hardware configurations of the replacement unit shall remain consistent with the original Device;
  3. Out-of-Stock Alternative Solution: If the corresponding model is out of stock, Speediance will consult with the user to offer options for queue placement or an equivalent alternative solution.
4.2.4 Benefit Redemption and Device Ownership
  1. Once the replacement unit enters the dispatch/shipping process, the one-time replacement benefit is automatically redeemed and cannot be revoked or restored;
  2. Upon receipt and sign-off of the replacement unit by the user, ownership of the defective old device automatically transfers to Speediance, and the user shall return the complete old unit pursuant to official instructions;
  3. Upon completion of the full-unit replacement service, the "hardware replacement" benefit under this Plan shall terminate. However, other unconsumed benefits included in your original plan (such as VIP Express Support, free resistance cable replacements, or Wellness+ membership where applicable) shall remain valid until the expiration of the original coverage period;
  4. Replacement devices provided under this Care Plan shall inherit the remaining warranty period of the original Care Plan, or carry a ninety (90) day warranty from the date of replacement, whichever is longer. The replacement device does not trigger a new 2-year base manufacturer warranty cycle.

4.3 Original Resistance Cable Free Replacement Right

Within the Total Coverage Period, you can apply for one (1) pair of original Speediance resistance cables for free, and Speediance will bear all standard logistics costs.

4.4 Wellness+ Exclusive Membership Rights

After purchase, you will receive a 1-month Wellness+ membership. The membership redemption code will be issued to your Wellness+ benefit card after Care activation and must be claimed by the user. The voucher code is valid for 12 months from the date of issuance, expiring at 11:59 PM local time on the day immediately preceding the 12-month anniversary.
Activation Method:
  1. Upon successful Care activation, the Wellness+ redemption code will be issued to your Wellness+ benefit card for manual collection;
  2. Activation Path: Open Speediance Device terminal / Mobile APP $$\rightarro$$ My $$\rightarro$$ Membership Redemption $$\rightarro$$ Enter redemption code;
  3. Click "Confirm Activation". The page will display membership validity and benefit details, unlocking all membership functions;
Remarks: If you already hold an active Wellness+ membership prior to redeeming, the system will prompt "You are already a member, cannot redeem." It is recommended to redeem after your current membership expires.

4.5 VIP Fast Track Service

Within the Total Coverage Period, you will enjoy exclusive priority customer service, including:
  • Top-priority processing of all-channel consultation support tickets;
  • Response within 12 hours during business hours;
  • Completion of damage assessment and issuance of solutions within 48 hours after failure report.

4.6 Gym Nano Two-Way Free Logistics Service Benefit (Applicable to Gym Nano)

4.6.1 Benefit Overview
Within the active coverage period of the Care Plan, if the Gym Nano main unit or factory-original core components experience functional failures due to material or workmanship defects, requiring the full unit to be returned to the service center for repair, two-way standard shipping costs shall be fully borne by Speediance.
4.6.2 Execution and Disclaimer Specifications
  • Official Shipping Labels and Transportation Standards: Repairs and returns must utilize prepaid shipping labels provided by Speediance and are strictly limited to standard ground transportation.
  • Packaging Requirements: Units must be packaged using original factory packaging or equivalent cushioned packaging meeting safe transportation standards. Secondary transit damage caused by improper packaging is excluded from warranty and free logistics coverage.
  • Exclusions and Fee Recoupment Circumstances: Speediance shall not cover full shipping costs, and reserves the right to recoup actual shipping expenses incurred, under any of the following circumstances: unauthorized C.O.D. shipments; units inspected and confirmed to have user-inflicted damage or no hardware defect; or user addresses located in Remote Areas (where excess mileage surcharges apply pursuant to the Remote Area terms).

5. Service Application and Performance Process

You may submit Care Service benefit applications through the following two methods:
A. On-Device Application (Recommended) After activating Care Service using your order number on the Device, you can submit repair or redemption requests directly within the respective benefit cards. Repair progress and logistics tracking details can be viewed directly on the Device.
B. Application via Official Channels You may also submit service applications, benefit claims, and consultation requests through official customer service channels at any time. When submitting an application, please provide your Care purchase order number, registered user ID, and Device SN Code for eligibility verification.

Execution Terms & Conditions:
  1. 30-Day Application Window: You must submit a performance application within thirty (30) days after discovering the Device failure (if the application cannot be submitted on time due to force majeure, the time limit shall be calculated from the date the force majeure event is eliminated). All applications must be submitted within the Total Coverage Period of this Plan; Speediance reserves the right to refuse overdue applications. To the extent permitted by law, any additional damage caused by severe delay in application shall not be covered.
  2. Initial Troubleshooting: Upon receiving the application, Speediance will first identify and resolve your problem through telephone, email, online chat, or remote assistance, and guide you to install software updates if necessary. If the above measures fail to solve the problem, we will issue a follow-up maintenance or replacement solution for you.
  3. Pre-Authorization Requirement: All maintenance and replacement services must be pre-authorized by Speediance prior to execution. Without Speediance authorization, you shall not return the Device on your own or entrust a third party to repair it; otherwise, Speediance reserves the right to refuse to bear relevant costs or honor corresponding rights.
  4. Failure Assessment and Performance Execution:
    1. For all failure report applications, Speediance will complete the failure assessment within 48 hours and issue a maintenance solution to you;
    2. Spare Parts Replacement / Resistance Cable Application: Upon passing verification, original factory spare parts/cables will be dispatched within 48 hours, with logistics tracking information synchronized. Speediance shall not be liable for delivery loss caused by incorrect or incomplete receiving addresses provided by the user;
    3. Full-Unit Replacement: Upon review and approval, the replacement unit will be dispatched within 48 hours, with logistics tracking information and return instructions for the old device synchronized.
  5. Warranty Commitment for Repaired and Replaced Parts: Based on the specific damage condition, Speediance may provide maintenance services, including repairing defective parts or replacing them with officially certified refurbished parts of the same type. During the remaining coverage period, the replaced product or parts shall enjoy the same warranty scope as the original product.
  6. Fulfillment Redemption Rules: Upon completion of service and user sign-off/acceptance, Speediance will synchronize the redemption of your corresponding benefit count and update service records. All service records can be queried through official channels.

6. Coverage Scope and Exclusions

6.1 Defined Coverage Scope

This Care Service exclusively covers Device failures and services expressly set forth below; requests beyond this scope fall outside performance liability, in full alignment with the original manufacturer base warranty policy:
  1. Free repair and original spare part replacement for functional failures of the Device's core components caused by material or workmanship defects within the Total Coverage Period;
  2. One-time free full-unit replacement service meeting agreed eligibility conditions, including full coverage of two-way standard shipping costs;
  3. Free replacement of original Speediance resistance cables within the agreed coverage period and allowance;
  4. Wellness+ membership benefits and VIP Express Support Service within the agreed coverage period.

6.2 Exclusions

Upon the occurrence of any of the following circumstances, Speediance reserves the right to refuse repair or benefit fulfillment services, and shall bear no liability for refunds or contract performance:
6.2.1 Improper Operation and Use (Damage or Loss Caused by User Misoperation)
  1. Product damage caused by non-manufacturing factors, including but not limited to improper installation, operation, disassembly, or failure to operate the Device pursuant to official instructions and the user manual;
  2. Damage resulting from continued workout or training after parts are damaged, as well as fault expansion, secondary damage, or consequential damage caused by failure to report a fault in a timely manner (Speediance assumes no warranty liability for such expanded or consequential damage);
  3. Damage caused by unauthorized circuit modifications, use of non-compliant chargers or external power supplies, or operating the product while the battery is depleted or defective;
  4. Indirect or consequential losses caused by improper installation or disassembly of the product, including damage to personal property, walls, flooring, etc.
6.2.2 Unauthorized Modification and Third-Party Intervention (Damage Caused by Unofficial Modifications or Third-Party Accessories)
  1. Damage resulting from unauthorized product modification, disassembly, or repair, or acceptance of non-official technical support (such as improper operation, configuration, or installation by a third party);
  2. Damage caused by intentional destruction or unauthorized tampering with the Device (including alteration of operating data);
  3. Product damage arising from reliability or compatibility issues due to the use of unauthorized third-party parts or accessories;
  4. Failure or damage of any third-party product (including third-party products integrated into Speediance products at the user's request).
6.2.3 Environmental and Force Majeure (Damage Caused by External Environment, Environmental Factors, and Force Majeure Events)
  1. Damage caused by exposure of the product to extreme environments, such as high temperature or corrosive conditions;
  2. Damage caused by operating the product in environments with electromagnetic interference or interference from other wireless devices;
  3. Damage caused by force majeure events, including fire, flood, earthquake, or power grid accidents/surges;
  4. Damage caused by improper custody, storage, or transport (such as accidental fire, water immersion, lightning strikes, etc.) or adverse environmental factors during storage, transportation, or use of the Device.
6.2.4 Normal Wear and Tear and Other Categories (Natural Wear and Tear, Scenario Violations, and Non-Hardware Exclusions)
  1. Normal wear and tear, metal rust, natural performance degradation, or cosmetic damage (including scratches, dents, plastic discoloration, etc.) caused by normal use or non-manufacturing/transportation reasons that do not affect normal Device functionality;
  2. Damage caused by using non-commercial products in commercial scenarios, including but not limited to commercial gyms, hotels, or private training studios;
  3. Denial of warranty service if the product or component identification labels or Serial Numbers (SN) have been altered, defaced, or removed;
  4. Pre-installed software programs or software subsequently installed by the user are excluded from hardware warranty coverage.

7. Cancellation and Refund Policy

This policy complies with applicable federal and provincial legal requirements in Canada regarding consumer protection and extended warranties. All approved refund requests will be returned to your original payment account within fifteen (15) business days.

7.1 Valuation of Bundled Products

Speediance Care is a value-added package containing multiple benefits. For the purpose of calculating refund amounts, the Manufacturer's Suggested Retail Price (MSRP) for each individual benefit is determined as follows (unless otherwise provided by provincial laws, where local laws shall govern):
  • Original Resistance Cable (Physical Good): $69.99 CAD
  • Wellness+ Membership (Digital Benefit): $34.99 CAD
  • VIP Express Support Service (Service Benefit): Valued at $50 CAD annually
  • One-Time Free Full-Unit Replacement Service: Fair market value of $600–$900 CAD per occurrence

7.2 60-Day Cooling-Off Period Full Refund

Within sixty (60) days from the date of purchase, if you have not activated or used any Care Service benefits (including but not limited to: no application for resistance cables, no activation of Wellness+ membership, and no failure reports or VIP customer support inquiries), you may apply for a 100% full refund with zero deduction.

7.3 Pro-Rata Refund After Benefit Activation or Beyond 60 Days

If you have activated or used part of the benefits after purchase, or if the refund application is submitted after 60 days from purchase, the refund amount will be calculated according to the following formula:
Refund Amount = [ (Original Care Purchase Price - Value of Consumed Benefits) × (Remaining Days of Coverage Period / Total Days of Coverage Period) ] - Administrative Fee ($35 CAD)
Description of Value of Consumed Benefits:
  • Physical Goods: Once the original resistance cable enters the dispatch/shipping process, $69.99 CAD will be deducted. Based on hygiene and safety standards, resistance cables are non-returnable for the purpose of offsetting this deduction.
  • Digital Services: Once the Wellness+ membership code is redeemed or activated, $34.99 CAD will be deducted.
  • Incurred Performance Costs: Includes costs associated with completed full-unit replacements and related spare parts.
  • Provincial Legal Exceptions: In provinces where deducting performance costs is prohibited by law, such performance service costs will not be deducted when calculating refunds; however, the value of delivered physical/digital goods and the administrative fee will still be deducted in accordance with applicable laws.

7.4 Administrative Fee

Except in cases of a full refund within the cooling-off period, all refund applications are subject to a $35 CAD administrative processing fee (or 10% of the total refund amount, whichever is lower; if local provincial laws impose lower statutory limits on administrative fees, local law shall govern) to cover operational costs associated with contract termination.

7.5 Synchronous Refund Rules for Hardware Return

  1. Full Return during Cooling-Off Period: If you apply for a full return and refund of the Device within the original manufacturer return cooling-off period, the Care Service can apply for a full refund synchronously without any deduction.
  2. Return due to Quality Issues: If you apply for a return and refund due to Device quality issues, the Care Service refund will be calculated pro-rata based on the remaining coverage days.
  3. Termination of Coverage: Upon completion of the Device return and refund, all bound Care Service benefits shall be permanently terminated immediately.

7.6 Loss Limitation

If the calculated refund amount is negative (that is, the total value of consumed benefits exceeds the purchase price), the actual refund amount will be processed as $0 CAD. We will not recover any difference exceeding the original payment amount from you.

7.7 Rules for Active Cancellation by the Brand

  1. Under the following circumstances, we will send a 30-day advance written notice to your registered email to terminate this Plan:
    1. Regulatory Requirements: Relevant regulatory authorities require us to cancel this Plan;
    2. Compliance Changes: A change in compliance affecting the performing entity of this Plan results in the inability to continue fulfilling the existing contract;
    3. Refund Settlement: In such circumstances, we will issue a pro-rata refund based on the remaining days of the coverage period, deducting the value of delivered physical/digital benefits (resistance cable $69.99 CAD, Wellness+ membership $34.99 CAD) and incurred performance costs (except in provinces where deducting performance costs is prohibited by law).
  2. If you meet any of the following conditions, we reserve the right to immediately cancel this Plan without any refund, and require you to pay the full cost of services already provided:
    1. You fail to pay the fees associated with this Plan and still fail to pay within 15 days after receiving our written reminder;
    2. You materially violate your obligations under these Terms, or substantially increase the performance risk of this extended warranty service due to intentional user-inflicted damage, unauthorized device modification, or other improper acts.

7.8 Termination of Rights After Refund

Regardless of the refund scenario, once the refund processing is completed, all Care Service benefits bound to your Device shall be permanently terminated immediately. You will no longer be eligible to claim any unused extended warranty benefits or submit failure report applications under this Care Service. If the Device is still within the Original Manufacturer’s Base Warranty Period, you may still report for repair normally through the base warranty channel. Care Service benefits are strictly non-transferable, non-cashable, and non-restorable.

8. User's Responsibilities and Obligations

This chapter is completely consistent with the Speediance Original Manufacturer Limited Warranty Policy:
  1. Obligation to Read the Terms: Please carefully read all the contents of these Terms and fully understand the coverage scope, restrictions, exclusions, and your obligations under this Plan.
  2. Device Maintenance Obligation: You must use, maintain, and service the Device normally in accordance with the requirements of the original manufacturer's user manual of the Device to ensure that the Device is in normal use condition.
  3. Record Keeping Obligation: Please properly keep the order confirmation voucher of this Plan, Device purchase invoice, maintenance service records, and other relevant documents, which are required to be provided when applying for services.
  4. Data Backup Responsibility: Please back up all personal data stored in the Device in advance before sending the Device for repair. We are not responsible for data loss or leakage during the repair process.
  5. Packaging Responsibility: If you need to return the Device for repair, please pack it in accordance with official standard packaging guidelines. All liability for transportation damage caused by improper packaging shall be borne by you.
  6. Receipt Inspection Obligation: After receiving the repaired/replaced Device, you should check the Device status within 72 hours. If no feedback is received within this time frame, the Device will be deemed undamaged and in good condition.
  7. Product Storage Rules: If the product cannot be delivered due to an incorrect receiving address provided by you or no one to sign for it, we will store the product for free for 30 days; after expiration, a storage fee of $30 CAD per day will be charged. If the product still cannot be delivered after 90 days, we have the right to dispose of the product after complying with local laws and sending a final written notice. The proceeds from disposal will be used to offset arrears first, and any balance will be handled in accordance with legal provisions.
  8. Compliant Use Obligation: If you use the product in violation of official instructions and the product user manual, or use the product for illegal purposes, we reserve the right to terminate the Care Service and original manufacturer warranty service.

9. Limitation of Liability

Speediance does not provide any form of warranty other than those expressly specified in these Terms and the original manufacturer limited warranty, including any implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement, and any warranties arising from trade, usage, or course of dealing.
  1. Except for the mandatory non-excludable provisions of local Canadian laws, the total cumulative performance liability of Speediance under this Care Service shall not exceed the original actual amount paid by you for the purchase of the Care Service. We are only liable for the performance of service content expressly agreed upon in these Terms. Any oral promises, descriptions, promotions, or third-party sales commitments beyond the scope of these Terms shall have no legal binding force unless confirmed in writing with an official seal or authorized signature of Speediance.
  2. For personal injury (including death) and property loss directly caused by Speediance's intentional misconduct or gross negligence, we will bear performance liability in accordance with local laws and regulations; Speediance shall not be liable for any losses caused by the user's own fault, violation of the rules of these Terms, or the fault of a third party.
  3. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, consequential, or punitive losses, including but not limited to Device idle losses, fitness plan interruption losses, lost wages, expected income losses, goodwill losses, etc. These Terms are bound by the mandatory laws of the provinces of Canada.
  4. Third-Party Liability Exemption: If damage to the Device is caused by the fault of a third party, and we have provided you with free maintenance or parts replacement, you agree to cooperate with us to assign the relevant right of cost recovery to Speediance, so that we may recover the actual maintenance costs from the at-fault party.

10. Provincial Legal Compliance Statement

These Terms are governed by the federal laws of Canada and the laws of the province where your Device was originally purchased. If any provision in these Terms conflicts with mandatory consumer protection regulations or extended warranty service laws of the province where your Device was purchased, the conflicting provision shall be subject to the mandatory legal provisions of your province, and the remaining terms shall remain in full legal force and effect. Some provinces do not allow limitations on implied warranties, limitations on consequential damages, or rules prohibiting refunds after major claims; therefore, the relevant limitation clauses above shall not apply to users in such provinces.

11. Dispute Resolution

This Dispute Resolution section is completely consistent with the Speediance Device Sales and Original Manufacturer Warranty Policy:
  1. Any dispute, claim, or controversy arising out of or relating to this Care Service shall first be resolved through friendly negotiation between both parties;
  2. If negotiation fails, the dispute shall be submitted to the court of competent jurisdiction in the province where your Device was originally purchased for litigation, governed by the substantive laws of said province (without regard to conflict of law principles);
  3. For disputes with a claim amount under $15,000 CAD (if you reside in the Province of Quebec) or not exceeding the statutory maximum limit of the Small Claims Court in your province (if you reside in a province other than Quebec), you may file a lawsuit directly in a Small Claims Court of competent jurisdiction without prior negotiation, and Speediance will fully cooperate with the procedural requirements of the Small Claims Court.

12. General Legal Provisions

  1. Entire Agreement: These Terms, the Speediance Original Manufacturer Limited Warranty Policy, and your Order Confirmation Voucher constitute the entire agreement between you and us regarding this Care Service, and supersede all previous oral or written statements and promises. No agent has the right to modify these Terms or waive any provisions of these Terms. Additional statements without our written confirmation with an official seal or authorized signature shall have no legal effect.
  2. Severability: If any content of these Terms is deemed invalid, illegal, or unenforceable by any relevant judicial authority, the provision shall be enforced to the maximum extent permitted by law, and the validity, legality, and enforceability of the remaining terms shall not be affected in any way.
  3. Privacy Protection: We strictly abide by relevant Canadian laws and regulations on privacy protection, collecting and using only the personal information necessary for the performance of the Care Service. You may request to access, correct, or delete your personal information through our official customer service channels at any time, and we will respond and process your request within the statutory time limit.
  4. Amendment of Terms: We reserve the right to revise these Terms in response to changes in laws and regulations or service resources. Revisions shall only take effect for Care Services newly purchased after the effective date of such revisions, and will not affect the rights and benefits of Care Services already purchased and in effect prior to the revision. We will not unilaterally reduce or impair the existing legal rights and benefits of users through amendments to these Terms.
  5. Assignment of Contract: We may assign all or part of our rights and obligations under this Plan at any time. Upon assignment, we will send a written notice to your registered email 30 days in advance and ensure that the assignee possesses the qualifications and capabilities required to perform all obligations under this Plan. If you have reasonable objections to the assignee, you have the right to notify us in writing to terminate this Plan within 15 days after receiving the assignment notice, and obtain a refund in accordance with Section 7.3 (refund rules for purchases over 60 days). After the assignment of rights and obligations, the new performing entity will fully assume all provisions under these Terms, and your guaranteed benefits under this Plan will not be affected in any way. You have no right to assign any rights or obligations under this Plan, which are strictly non-transferable.
  6. Force Majeure Exemption: If we are unable to perform the contract or provide services on time due to force majeure events such as earthquakes, fires, floods, war, or government bans, we shall not bear performance liability, but will make commercially reasonable efforts to notify you in advance and resume services as soon as possible after the force majeure event ends.

Service Benchmark

These Terms constitute a supplementary extended warranty service agreement to Speediance's Original Manufacturer Limited Warranty Policy. For the exclusive value-added rights and interests under the Care Plan, these Terms shall prevail. For general provisions on hardware warranty scope and exclusions, in the event of any inconsistency or ambiguity between these Terms and the Speediance Original Manufacturer Limited Warranty Policy, the Original Manufacturer Limited Warranty Policy shall prevail. The after-sales maintenance service standards during the extended warranty period are exactly the same as those under the original 2-year base manufacturer warranty.
These service terms and conditions constitute a legally binding service contract between Speediance and the User, and are strictly governed by the federal laws of Canada and the laws of the province where your Device was originally purchased. By completing the purchase, activation of the Speediance Care product, or using any of the service rights and interests, you are deemed to have fully read, understood and unconditionally accepted all the contents of these Terms and the Speediance Original Manufacturer Limited Warranty Policy.

1. Definition of Key Terms

All terms herein are defined in accordance with the general standards of the extended warranty service industry in Canada, combined with the business rules of Speediance Care, as follows:
  1. Care Service / this Plan / these Terms: refers to the Speediance Care service product you purchased, including two editions: Speediance 3-Year Care (3-year Edition) and Speediance 4-Year Care (4-year Edition). The specific service content is subject to the provisions of these Terms; this Care Plan constitutes a service contract, not an insurance policy.
  2. Original Manufacturer’s Base Warranty Period: refers to the 2-year limited hardware warranty period provided with the Device, calculated from 00:00 on the date of delivery and signature of the Device. The specific rules are subject to the Speediance Original Manufacturer Limited Warranty Policy.
  3. Extended Warranty Period: refers to the period during which Speediance provides extended warranty service for core components after the expiration of the Original Manufacturer’s Base Warranty Period. The Extended Warranty Period is 12 months for the Speediance 3-Year Care (3-year Edition) and 24 months for the Speediance 4-Year Care (4-year Edition).
  4. Total Coverage Period: refers to the total duration of the Original Manufacturer’s Base Warranty Period of the Device plus the Extended Warranty Period of the Care Service
    1. Speediance 3-Year Care: Duration: 36 months total; Effective Date: Device receipt date; Expiry Date: 11:59 PM local time on the day immediately preceding the 36-month anniversary of the Machine Delivery Date
    2. Speediance 4-Year Care: Duration: 48 months total; Effective Date: Device receipt date; Expiry Date: 11:59 PM local time on the day immediately preceding the 48-month anniversary of the Machine Delivery Date
  5. Device Host SN Code / Serial Number: refers to the product serial number on the Device host body, which is the core credential for Care Service binding, rights verification, and identity authentication.
  6. Official After-sales Support Center: refers to Speediance's official remote technical team and designated cooperative logistics fulfillment centers, providing remote diagnostic and spare parts/replacement delivery services.
  7. Administrator: refers to the entity responsible for the sales, rights management, and service request processing of this Plan, namely Speediance Inc. All maintenance services must be pre-authorized by the Administrator before execution.
  8. Original Purchaser / You / User: refers to the user who purchased the Device through Speediance Canada's official Direct-to-Consumer (DTC) website and Amazon Canada, and is the sole legal holder of the rights and interests under this Service.
  9. Plan Price: refers to the full amount you paid for the purchase of the Care Service, subject to the order confirmation voucher.
  10. Order Confirmation Voucher: refers to the order invoice, receipt or confirmation email sent to you by Speediance after you purchase the Care Service, which records the core information such as the coverage period, edition type, and Plan Price of this Plan.
  11. Pre-existing Condition: refers to the failure, damage, or latent defect of the Device that already existed before you purchased the Care Service, including failures that have been reported but not addressed during the Original Manufacturer’s Base Warranty Period.
  12. One-Time Free Whole Device Replacement Service: refers to 1 free whole device replacement service provided by Speediance to the user when the agreed conditions are met within the Total Coverage Period, with full coverage of two-way standard logistics costs and no hidden fees.
  13. Remote Areas: refers to Yukon, Northwest Territories, Nunavut, and specific postal code areas in Canada requiring special air or sea freight delivery.

2. Service Editions and Coverage Period

2.2 Special Provisions for Officially Certified Refurbished Devices

Officially certified refurbished devices are eligible to purchase the Care Service only within their original manufacturer warranty period (calculated from 00:00 on the date of delivery to the user). The coverage scope, service standards, and value-added benefits of the Care Service are identical to those for brand-new devices. Minor cosmetic defects on refurbished devices (such as light scratches, chipped paint, or wear that do not affect device functionality) are excluded from Care Service coverage.

3. Purchase Eligibility and Effective Rules

Care Services must be activated on the Device end to take effect and display benefits. Enter the order number (obtained via email or the official website) on the machine screen to activate 5 core Care benefits. (Path: Profile → Speediance Care → Activate Care)
  1. Basic Purchase Eligibility: The purchase of Care Services is exclusively restricted to the Original Purchaser during the Device's original 2-year base manufacturer warranty period. After the Device's original base warranty expires, the eligibility to purchase Care Services shall be permanently closed.
  2. Device Status Requirement: At the time of purchasing Care Services, the Device must be in normal working condition (fully functional and free of unresolved functional faults or physical damage). The Device shall be free of unauthorized disassembly, uncertified repairs, liquid damage, or physical impact. A Device that previously experienced malfunctions during the base warranty period remains eligible, provided such malfunctions have been fully repaired to original factory standards via official warranty channels.
  3. Binding Rules: A strict policy of one Care Service plan per Device Serial Number (SN Code) for the life of the Device shall be enforced. Repeated purchases or stacking of benefits are strictly prohibited. For the avoidance of doubt, a Speediance 3-Year Care plan cannot be upgraded to a Speediance 4-Year Care plan.
  4. Non-transferability Rule: This Care Service is strictly bound to both the Device SN Code and the Original Purchaser’s user ID, and is non-transferable, non-assignable, and non-divisible. It may not be transferred in connection with any second-hand sale, gift, lease, or other disposition of the Device, which is fully consistent with the non-transferability of the original manufacturer base warranty. Upon any change in ownership of the Device, all associated Care Service benefits shall automatically terminate, and no services shall be provided to any subsequent owner. Statutory warranties of the Device are not restricted by this clause; if you reside in the Province of Quebec, relevant matters shall be governed in accordance with the statutory provisions of local consumer protection laws.
  5. Purchase Channels: This Care Service may only be purchased through Speediance Canada's official DTC website. For Care Services purchased through unauthorized or unofficial channels, Speediance reserves the right to refuse service and shall bear no refund or performance liability.
  6. No Global Warranty Rule: Performance of this Care Service is strictly limited to the territory of Canada. No international or global warranty services are provided hereunder. For any repairs requested or conducted outside Canada, the user shall be solely responsible for all associated costs, including but not limited to tariffs, customs clearance, transportation, and warehousing expenses, in full alignment with the original manufacturer base warranty policy.

4. Core Service Rights and Interests

4.1 Core Component Extended Warranty Service

Adapts to the entire Speediance Gym series. During the coverage period, repair standards identical to the base warranty are provided for functional failures caused by material or manufacturing quality defects in core components (motors, driver boards, screens, mainboards, pulleys, casters, pedals, brackets).
  1. Exclusions (covered only by the base warranty): Rowing machine, flat bench, adjustable bench, Bluetooth ring, barbell hooks, barbell shoulder pad, adjustable barbell, rowing handle, ankle straps, triceps rope, general handles, ski handles, smart handles, yoga mat, weightlifting belt, extension straps, accessory storage rack, ball joints, resistance band kit, and Gym Nano battery.

4.2 One-Time Free Full-Unit Replacement Service

Within the Total Coverage Period, the user is entitled to one (1) free full-unit replacement service, with two-way standard logistics costs fully borne by Speediance. This one-time free replacement service is applicable exclusively to mechanical or electrical failures.
4.2.1 Applicable Trigger Conditions (Effective upon meeting any condition)
  1. Unrepairable Device Failure: Complex functional failures that cannot be resolved after official remote diagnosis and spare parts replacement, requiring an in-depth overhaul of the whole unit;
  2. High-Value Core Component Failure: Simultaneous damage to multiple core components where the total repair cost is severely disproportionate to the value of the Device itself.
4.2.2 Inapplicable and Excluded Circumstances
  1. Minor failures that can be effectively resolved through remote technical guidance or standard parts replacement will not trigger the replacement benefit;
  2. Full-unit replacement eligibility must be professionally inspected, reviewed, and officially confirmed by Speediance authorized service engineers;
  3. Damage resulting from user-inflicted damage, unauthorized disassembly or repair, uncertified modification, third-party maintenance, commercial use, overload/abuse, or force majeure events shall not be eligible for replacement service.
4.2.3 Device Replacement Rules
  1. Speediance may replace your Device with a unit of identical specifications and normal operating condition. The replacement unit may be a new device or a certified refurbished unit that meets manufacturer standards and equivalent quality;
  2. The functional specifications and hardware configurations of the replacement unit shall remain consistent with the original Device;
  3. Out-of-Stock Alternative Solution: If the corresponding model is out of stock, Speediance will consult with the user to offer options for queue placement or an equivalent alternative solution.
4.2.4 Benefit Redemption and Device Ownership
  1. Once the replacement unit enters the dispatch/shipping process, the one-time replacement benefit is automatically redeemed and cannot be revoked or restored;
  2. Upon receipt and sign-off of the replacement unit by the user, ownership of the defective old device automatically transfers to Speediance, and the user shall return the complete old unit pursuant to official instructions;
  3. Upon completion of the full-unit replacement service, the "hardware replacement" benefit under this Plan shall terminate. However, other unconsumed benefits included in your original plan (such as VIP Express Support, free resistance cable replacements, or Wellness+ membership where applicable) shall remain valid until the expiration of the original coverage period;
  4. Replacement devices provided under this Care Plan shall inherit the remaining warranty period of the original Care Plan, or carry a ninety (90) day warranty from the date of replacement, whichever is longer. The replacement device does not trigger a new 2-year base manufacturer warranty cycle.

4.3 Original Resistance Cable Free Replacement Right

Within the Total Coverage Period, you can apply for one (1) pair of original Speediance resistance cables for free, and Speediance will bear all standard logistics costs.

4.4 Wellness+ Exclusive Membership Rights

After purchase, you will receive a 1-month Wellness+ membership. The membership redemption code will be issued to your Wellness+ benefit card after Care activation and must be claimed by the user. The voucher code is valid for 12 months from the date of issuance, expiring at 11:59 PM local time on the day immediately preceding the 12-month anniversary.
Activation Method:
  1. Upon successful Care activation, the Wellness+ redemption code will be issued to your Wellness+ benefit card for manual collection;

Within the Total Coverage Period, you will enjoy exclusive priority customer service, including:
  • Top-priority processing of all-channel consultation support tickets;

  • Completion of damage assessment and issuance of solutions within 48 hours after failure report.

4.6 Gym Nano Two-Way Free Logistics Service Benefit (Applicable to Gym Nano)

4.6.1 Benefit Overview
Within the active coverage period of the Care Plan, if the Gym Nano main unit or factory-original core components experience functional failures due to material or workmanship defects, requiring the full unit to be returned to the service center for repair, two-way standard shipping costs shall be fully borne by Speediance.
4.6.2 Execution and Disclaimer Specifications
  • Official Shipping Labels and Transportation Standards: Repairs and returns must utilize prepaid shipping labels provided by Speediance and are strictly limited to standard ground transportation.
  • Packaging Requirements: Units must be packaged using original factory packaging or equivalent cushioned packaging meeting safe transportation standards. Secondary transit damage caused by improper packaging is excluded from warranty and free logistics coverage.
  • Exclusions and Fee Recoupment Circumstances: Speediance shall not cover full shipping costs, and reserves the right to recoup actual shipping expenses incurred, under any of the following circumstances: unauthorized C.O.D. shipments; units inspected and confirmed to have user-inflicted damage or no hardware defect; or user addresses located in Remote Areas (where excess mileage surcharges apply pursuant to the Remote Area terms).

5. Service Application and Performance Process

You may submit Care Service benefit applications through the following two methods:
A. On-Device Application (Recommended) After activating Care Service using your order number on the Device, you can submit repair or redemption requests directly within the respective benefit cards. Repair progress and logistics tracking details can be viewed directly on the Device.
B. Application via Official Channels You may also submit service applications, benefit claims, and consultation requests through official customer service channels at any time. When submitting an application, please provide your Care purchase order number, registered user ID, and Device SN Code for eligibility verification.

Execution Terms & Conditions:
  1. 30-Day Application Window: You must submit a performance application within thirty (30) days after discovering the Device failure (if the application cannot be submitted on time due to force majeure, the time limit shall be calculated from the date the force majeure event is eliminated). All applications must be submitted within the Total Coverage Period of this Plan; Speediance reserves the right to refuse overdue applications. To the extent permitted by law, any additional damage caused by severe delay in application shall not be covered.
  2. Initial Troubleshooting: Upon receiving the application, Speediance will first identify and resolve your problem through telephone, email, online chat, or remote assistance, and guide you to install software updates if necessary. If the above measures fail to solve the problem, we will issue a follow-up maintenance or replacement solution for you.
  3. Pre-Authorization Requirement: All maintenance and replacement services must be pre-authorized by Speediance prior to execution. Without Speediance authorization, you shall not return the Device on your own or entrust a third party to repair it; otherwise, Speediance reserves the right to refuse to bear relevant costs or honor corresponding rights.
  4. Failure Assessment and Performance Execution:
    1. For all failure report applications, Speediance will complete the failure assessment within 48 hours and issue a maintenance solution to you;
    2. Spare Parts Replacement / Resistance Cable Application: Upon passing verification, original factory spare parts/cables will be dispatched within 48 hours, with logistics tracking information synchronized. Speediance shall not be liable for delivery loss caused by incorrect or incomplete receiving addresses provided by the user;
    3. Full-Unit Replacement: Upon review and approval, the replacement unit will be dispatched within 48 hours, with logistics tracking information and return instructions for the old device synchronized.
  5. Warranty Commitment for Repaired and Replaced Parts: Based on the specific damage condition, Speediance may provide maintenance services, including repairing defective parts or replacing them with officially certified refurbished parts of the same type. During the remaining coverage period, the replaced product or parts shall enjoy the same warranty scope as the original product.
  6. Fulfillment Redemption Rules: Upon completion of service and user sign-off/acceptance, Speediance will synchronize the redemption of your corresponding benefit count and update service records. All service records can be queried through official channels.

6. Coverage Scope and Exclusions

6.1 Defined Coverage Scope

This Care Service exclusively covers Device failures and services expressly set forth below; requests beyond this scope fall outside performance liability, in full alignment with the original manufacturer base warranty policy:
  1. Free repair and original spare part replacement for functional failures of the Device's core components caused by material or workmanship defects within the Total Coverage Period;
  2. One-time free full-unit replacement service meeting agreed eligibility conditions, including full coverage of two-way standard shipping costs;
  3. Free replacement of original Speediance resistance cables within the agreed coverage period and allowance;
  4. Wellness+ membership benefits and VIP Express Support Service within the agreed coverage period.

6.2 Exclusions

Upon the occurrence of any of the following circumstances, Speediance reserves the right to refuse repair or benefit fulfillment services, and shall bear no liability for refunds or contract performance:
6.2.1 Improper Operation and Use (Damage or Loss Caused by User Misoperation)
  1. Product damage caused by non-manufacturing factors, including but not limited to improper installation, operation, disassembly, or failure to operate the Device pursuant to official instructions and the user manual;
  2. Damage resulting from continued workout or training after parts are damaged, as well as fault expansion, secondary damage, or consequential damage caused by failure to report a fault in a timely manner (Speediance assumes no warranty liability for such expanded or consequential damage);
  3. Damage caused by unauthorized circuit modifications, use of non-compliant chargers or external power supplies, or operating the product while the battery is depleted or defective;
  4. Indirect or consequential losses caused by improper installation or disassembly of the product, including damage to personal property, walls, flooring, etc.
6.2.2 Unauthorized Modification and Third-Party Intervention (Damage Caused by Unofficial Modifications or Third-Party Accessories)
  1. Damage resulting from unauthorized product modification, disassembly, or repair, or acceptance of non-official technical support (such as improper operation, configuration, or installation by a third party);
  2. Damage caused by intentional destruction or unauthorized tampering with the Device (including alteration of operating data);
  3. Product damage arising from reliability or compatibility issues due to the use of unauthorized third-party parts or accessories;
  4. Failure or damage of any third-party product (including third-party products integrated into Speediance products at the user's request).
6.2.3 Environmental and Force Majeure (Damage Caused by External Environment, Environmental Factors, and Force Majeure Events)
  1. Damage caused by exposure of the product to extreme environments, such as high temperature or corrosive conditions;
  2. Damage caused by operating the product in environments with electromagnetic interference or interference from other wireless devices;
  3. Damage caused by force majeure events, including fire, flood, earthquake, or power grid accidents/surges;
  4. Damage caused by improper custody, storage, or transport (such as accidental fire, water immersion, lightning strikes, etc.) or adverse environmental factors during storage, transportation, or use of the Device.
6.2.4 Normal Wear and Tear and Other Categories (Natural Wear and Tear, Scenario Violations, and Non-Hardware Exclusions)
  1. Normal wear and tear, metal rust, natural performance degradation, or cosmetic damage (including scratches, dents, plastic discoloration, etc.) caused by normal use or non-manufacturing/transportation reasons that do not affect normal Device functionality;
  2. Damage caused by using non-commercial products in commercial scenarios, including but not limited to commercial gyms, hotels, or private training studios;
  3. Denial of warranty service if the product or component identification labels or Serial Numbers (SN) have been altered, defaced, or removed;
  4. Pre-installed software programs or software subsequently installed by the user are excluded from hardware warranty coverage.

7. Cancellation and Refund Policy

This policy complies with applicable federal and provincial legal requirements in Canada regarding consumer protection and extended warranties. All approved refund requests will be returned to your original payment account within fifteen (15) business days.

7.1 Valuation of Bundled Products

Speediance Care is a value-added package containing multiple benefits. For the purpose of calculating refund amounts, the Manufacturer's Suggested Retail Price (MSRP) for each individual benefit is determined as follows (unless otherwise provided by provincial laws, where local laws shall govern):
  • Original Resistance Cable (Physical Good): $69.99 CAD
  • Wellness+ Membership (Digital Benefit): $34.99 CAD
  • VIP Express Support Service (Service Benefit): Valued at $50 CAD annually
  • One-Time Free Full-Unit Replacement Service: Fair market value of $600–$900 CAD per occurrence

7.2 60-Day Cooling-Off Period Full Refund

Within sixty (60) days from the date of purchase, if you have not activated or used any Care Service benefits (including but not limited to: no application for resistance cables, no activation of Wellness+ membership, and no failure reports or VIP customer support inquiries), you may apply for a 100% full refund with zero deduction.

7.3 Pro-Rata Refund After Benefit Activation or Beyond 60 Days

If you have activated or used part of the benefits after purchase, or if the refund application is submitted after 60 days from purchase, the refund amount will be calculated according to the following formula:
Refund Amount = [ (Original Care Purchase Price - Value of Consumed Benefits) × (Remaining Days of Coverage Period / Total Days of Coverage Period) ] - Administrative Fee ($35 CAD)
Description of Value of Consumed Benefits:
  • Physical Goods: Once the original resistance cable enters the dispatch/shipping process, $69.99 CAD will be deducted. Based on hygiene and safety standards, resistance cables are non-returnable for the purpose of offsetting this deduction.
  • Digital Services: Once the Wellness+ membership code is redeemed or activated, $34.99 CAD will be deducted.
  • Incurred Performance Costs: Includes costs associated with completed full-unit replacements and related spare parts.
  • Provincial Legal Exceptions: In provinces where deducting performance costs is prohibited by law, such performance service costs will not be deducted when calculating refunds; however, the value of delivered physical/digital goods and the administrative fee will still be deducted in accordance with applicable laws.

7.4 Administrative Fee

Except in cases of a full refund within the cooling-off period, all refund applications are subject to a $35 CAD administrative processing fee (or 10% of the total refund amount, whichever is lower; if local provincial laws impose lower statutory limits on administrative fees, local law shall govern) to cover operational costs associated with contract termination.

7.5 Synchronous Refund Rules for Hardware Return

  1. Full Return during Cooling-Off Period: If you apply for a full return and refund of the Device within the original manufacturer return cooling-off period, the Care Service can apply for a full refund synchronously without any deduction.
  2. Return due to Quality Issues: If you apply for a return and refund due to Device quality issues, the Care Service refund will be calculated pro-rata based on the remaining coverage days.
  3. Termination of Coverage: Upon completion of the Device return and refund, all bound Care Service benefits shall be permanently terminated immediately.

7.6 Loss Limitation

If the calculated refund amount is negative (that is, the total value of consumed benefits exceeds the purchase price), the actual refund amount will be processed as $0 CAD. We will not recover any difference exceeding the original payment amount from you.

7.7 Rules for Active Cancellation by the Brand

  1. Under the following circumstances, we will send a 30-day advance written notice to your registered email to terminate this Plan:
    1. Regulatory Requirements: Relevant regulatory authorities require us to cancel this Plan;
    2. Compliance Changes: A change in compliance affecting the performing entity of this Plan results in the inability to continue fulfilling the existing contract;
    3. Refund Settlement: In such circumstances, we will issue a pro-rata refund based on the remaining days of the coverage period, deducting the value of delivered physical/digital benefits (resistance cable $69.99 CAD, Wellness+ membership $34.99 CAD) and incurred performance costs (except in provinces where deducting performance costs is prohibited by law).
  2. If you meet any of the following conditions, we reserve the right to immediately cancel this Plan without any refund, and require you to pay the full cost of services already provided:
    1. You fail to pay the fees associated with this Plan and still fail to pay within 15 days after receiving our written reminder;
    2. You materially violate your obligations under these Terms, or substantially increase the performance risk of this extended warranty service due to intentional user-inflicted damage, unauthorized device modification, or other improper acts.

7.8 Termination of Rights After Refund

Regardless of the refund scenario, once the refund processing is completed, all Care Service benefits bound to your Device shall be permanently terminated immediately. You will no longer be eligible to claim any unused extended warranty benefits or submit failure report applications under this Care Service. If the Device is still within the Original Manufacturer’s Base Warranty Period, you may still report for repair normally through the base warranty channel. Care Service benefits are strictly non-transferable, non-cashable, and non-restorable.

8. User's Responsibilities and Obligations

This chapter is completely consistent with the Speediance Original Manufacturer Limited Warranty Policy:
  1. Obligation to Read the Terms: Please carefully read all the contents of these Terms and fully understand the coverage scope, restrictions, exclusions, and your obligations under this Plan.
  2. Device Maintenance Obligation: You must use, maintain, and service the Device normally in accordance with the requirements of the original manufacturer's user manual of the Device to ensure that the Device is in normal use condition.
  3. Record Keeping Obligation: Please properly keep the order confirmation voucher of this Plan, Device purchase invoice, maintenance service records, and other relevant documents, which are required to be provided when applying for services.
  4. Data Backup Responsibility: Please back up all personal data stored in the Device in advance before sending the Device for repair. We are not responsible for data loss or leakage during the repair process.
  5. Packaging Responsibility: If you need to return the Device for repair, please pack it in accordance with official standard packaging guidelines. All liability for transportation damage caused by improper packaging shall be borne by you.
  6. Receipt Inspection Obligation: After receiving the repaired/replaced Device, you should check the Device status within 72 hours. If no feedback is received within this time frame, the Device will be deemed undamaged and in good condition.
  7. Product Storage Rules: If the product cannot be delivered due to an incorrect receiving address provided by you or no one to sign for it, we will store the product for free for 30 days; after expiration, a storage fee of $30 CAD per day will be charged. If the product still cannot be delivered after 90 days, we have the right to dispose of the product after complying with local laws and sending a final written notice. The proceeds from disposal will be used to offset arrears first, and any balance will be handled in accordance with legal provisions.
  8. Compliant Use Obligation: If you use the product in violation of official instructions and the product user manual, or use the product for illegal purposes, we reserve the right to terminate the Care Service and original manufacturer warranty service.

9. Limitation of Liability

Speediance does not provide any form of warranty other than those expressly specified in these Terms and the original manufacturer limited warranty, including any implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement, and any warranties arising from trade, usage, or course of dealing.
  1. Except for the mandatory non-excludable provisions of local Canadian laws, the total cumulative performance liability of Speediance under this Care Service shall not exceed the original actual amount paid by you for the purchase of the Care Service. We are only liable for the performance of service content expressly agreed upon in these Terms. Any oral promises, descriptions, promotions, or third-party sales commitments beyond the scope of these Terms shall have no legal binding force unless confirmed in writing with an official seal or authorized signature of Speediance.
  2. For personal injury (including death) and property loss directly caused by Speediance's intentional misconduct or gross negligence, we will bear performance liability in accordance with local laws and regulations; Speediance shall not be liable for any losses caused by the user's own fault, violation of the rules of these Terms, or the fault of a third party.
  3. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, consequential, or punitive losses, including but not limited to Device idle losses, fitness plan interruption losses, lost wages, expected income losses, goodwill losses, etc. These Terms are bound by the mandatory laws of the provinces of Canada.
  4. Third-Party Liability Exemption: If damage to the Device is caused by the fault of a third party, and we have provided you with free maintenance or parts replacement, you agree to cooperate with us to assign the relevant right of cost recovery to Speediance, so that we may recover the actual maintenance costs from the at-fault party.

10. Provincial Legal Compliance Statement

These Terms are governed by the federal laws of Canada and the laws of the province where your Device was originally purchased. If any provision in these Terms conflicts with mandatory consumer protection regulations or extended warranty service laws of the province where your Device was purchased, the conflicting provision shall be subject to the mandatory legal provisions of your province, and the remaining terms shall remain in full legal force and effect. Some provinces do not allow limitations on implied warranties, limitations on consequential damages, or rules prohibiting refunds after major claims; therefore, the relevant limitation clauses above shall not apply to users in such provinces.

11. Dispute Resolution

This Dispute Resolution section is completely consistent with the Speediance Device Sales and Original Manufacturer Warranty Policy:
  1. Any dispute, claim, or controversy arising out of or relating to this Care Service shall first be resolved through friendly negotiation between both parties;
  2. If negotiation fails, the dispute shall be submitted to the court of competent jurisdiction in the province where your Device was originally purchased for litigation, governed by the substantive laws of said province (without regard to conflict of law principles);
  3. For disputes with a claim amount under $15,000 CAD (if you reside in the Province of Quebec) or not exceeding the statutory maximum limit of the Small Claims Court in your province (if you reside in a province other than Quebec), you may file a lawsuit directly in a Small Claims Court of competent jurisdiction without prior negotiation, and Speediance will fully cooperate with the procedural requirements of the Small Claims Court.

12. General Legal Provisions

  1. Entire Agreement: These Terms, the Speediance Original Manufacturer Limited Warranty Policy, and your Order Confirmation Voucher constitute the entire agreement between you and us regarding this Care Service, and supersede all previous oral or written statements and promises. No agent has the right to modify these Terms or waive any provisions of these Terms. Additional statements without our written confirmation with an official seal or authorized signature shall have no legal effect.
  2. Severability: If any content of these Terms is deemed invalid, illegal, or unenforceable by any relevant judicial authority, the provision shall be enforced to the maximum extent permitted by law, and the validity, legality, and enforceability of the remaining terms shall not be affected in any way.
  3. Privacy Protection: We strictly abide by relevant Canadian laws and regulations on privacy protection, collecting and using only the personal information necessary for the performance of the Care Service. You may request to access, correct, or delete your personal information through our official customer service channels at any time, and we will respond and process your request within the statutory time limit.
  4. Amendment of Terms: We reserve the right to revise these Terms in response to changes in laws and regulations or service resources. Revisions shall only take effect for Care Services newly purchased after the effective date of such revisions, and will not affect the rights and benefits of Care Services already purchased and in effect prior to the revision. We will not unilaterally reduce or impair the existing legal rights and benefits of users through amendments to these Terms.
  5. Assignment of Contract: We may assign all or part of our rights and obligations under this Plan at any time. Upon assignment, we will send a written notice to your registered email 30 days in advance and ensure that the assignee possesses the qualifications and capabilities required to perform all obligations under this Plan. If you have reasonable objections to the assignee, you have the right to notify us in writing to terminate this Plan within 15 days after receiving the assignment notice, and obtain a refund in accordance with Section 7.3 (refund rules for purchases over 60 days). After the assignment of rights and obligations, the new performing entity will fully assume all provisions under these Terms, and your guaranteed benefits under this Plan will not be affected in any way. You have no right to assign any rights or obligations under this Plan, which are strictly non-transferable.
  6. Force Majeure Exemption: If we are unable to perform the contract or provide services on time due to force majeure events such as earthquakes, fires, floods, war, or government bans, we shall not bear performance liability, but will make commercially reasonable efforts to notify you in advance and resume services as soon as possible after the force majeure event ends.
