Eligible Devices: Genuine GYM2 and GYM2S smart fitness devices (including officially certified refurbished devices, hereinafter referred to as the "Device") purchased exclusively through Speediance Canada Official Website and Amazon Canada.
Service Benchmark
These Terms constitute a supplementary extended warranty service agreement to Speediance's Original Manufacturer Limited Warranty Policy. For the exclusive value-added rights and interests under the Care Plan, these Terms shall prevail. For general provisions on hardware warranty scope and exclusions, in the event of any inconsistency or ambiguity between these Terms and the Speediance Original Manufacturer Limited Warranty Policy, the Original Manufacturer Limited Warranty Policy shall prevail. The after-sales maintenance service standards during the extended warranty period are exactly the same as those under the original 2-year base manufacturer warranty.
These service terms and conditions constitute a legally binding service contract between Speediance and the User, and are strictly governed by the federal laws of Canada and the laws of the province where your Device was originally purchased. By completing the purchase, activation of the Speediance Care product, or using any of the service rights and interests, you are deemed to have fully read, understood and unconditionally accepted all the contents of these Terms and the Speediance Original Manufacturer Limited Warranty Policy.
1. Definition of Key Terms
All terms herein are defined in accordance with the general standards of the extended warranty service industry in Canada, combined with the business rules of Speediance Care, as follows:

Care Service / this Plan / these Terms: refers to the Speediance Care service product you purchased, including two editions: Speediance 3-Year Care (3-year Edition) and Speediance 4-Year Care (4-year Edition). The specific service content is subject to the provisions of these Terms; this Care Plan constitutes a service contract, not an insurance policy.

Original Manufacturer’s Base Warranty Period: refers to the 2-year limited hardware warranty period provided with the Device, calculated from 00:00 on the date of delivery and signature of the Device. The specific rules are subject to the Speediance Original Manufacturer Limited Warranty Policy.

Extended Warranty Period: refers to the period during which Speediance provides extended warranty service for core components after the expiration of the Original Manufacturer’s Base Warranty Period. The Extended Warranty Period is 12 months for the Speediance 3-Year Care (3-year Edition) and 24 months for the Speediance 4-Year Care (4-year Edition).

Total Coverage Period: refers to the total duration of the Original Manufacturer’s Base Warranty Period of the Device plus the Extended Warranty Period of the Care Service

Speediance 3-Year Care (3-year Edition): total 36 months, effective on the date of Device signature, expiring on the 36th month anniversary of the Device signature date

Speediance 4-Year Care (4-year Edition): total 48 months, effective on the date of Device signature, expiring on the 48th month anniversary of the Device signature date

Device Host SN Code / Serial Number: refers to the product serial number on the Device host body, which is the core credential for Care Service binding, rights verification, and identity authentication.

Authorized Service Provider: refers to a local third-party service organization contracted by Speediance and professionally certified to provide Device inspection and spare parts replacement services for users, and is the only recognized maintenance execution entity under this Plan.

Administrator: refers to the entity responsible for the sales, rights management, and service request processing of this Plan, namely Speediance Inc. All maintenance services must be pre-authorized by the Administrator before execution.

Original Purchaser / You / User: refers to the user who purchased the Device through Speediance Canada's official Direct-to-Consumer (DTC) website and Amazon Canada, and is the sole legal holder of the rights and interests under this Service.

Plan Price: refers to the full amount you paid for the purchase of the Care Service, subject to the order confirmation voucher.
-
Order Confirmation Voucher: refers to the order invoice, receipt or confirmation email sent to you by Speediance after you purchase the Care Service, which records the core information such as the coverage period, edition type, and Plan Price of this Plan.

Pre-existing Condition: refers to the failure, damage, or latent defect of the Device that already existed before you purchased the Care Service, including failures that have been reported but not addressed during the Original Manufacturer’s Base Warranty Period.

One-Time Free Whole Device Replacement Service: refers to 1 free whole device replacement service provided by Speediance to the user when the agreed conditions are met within the Total Coverage Period, with full coverage of two-way standard logistics costs and no hidden fees.
2. Service Editions and Coverage Period
2.1 Product Rights and Specifications
Speediance Care provides two official service editions for users in the Canadian market. The after-sales maintenance service standards during the extended warranty period of all editions are exactly the same as the original 2-year base manufacturer warranty of the Device. In addition to the core component extended warranty coverage, this Plan is also equipped with exclusive value-added rights and interests. The unified retail price, coverage period, and full details of rights and interests of the two editions are as follows:

2.3 Special Provisions for Officially Certified Refurbished Devices
Officially certified refurbished devices are only eligible to purchase the Care Service within the original manufacturer warranty period of the Device (the original manufacturer warranty period for refurbished devices is calculated from 00:00 on the date when the refurbishment is completed and the Device is delivered to the user). The coverage scope, service standards, and value-added rights of the Care Service are exactly the same as those for brand-new devices; minor appearance defects of officially certified refurbished devices (such as minor scratches, paint chipping, wear and tear, etc., that do not affect the functional use of the Device) are not covered by the Care Service.
3. Purchase Eligibility and Effective Rules

Basic Purchase Eligibility: Only the Original Purchaser of the Device within the 2-year Original Manufacturer’s Base Warranty Period is eligible to purchase. After the Device exceeds the Original Manufacturer’s Base Warranty Period, the purchase permission will be permanently closed.

Device Status Requirement: When purchasing the Care Service, the Device must be in normal working condition (complete functions, intact appearance), without unauthorized disassembly and repair, liquid ingress, physical damage, or unresolved functional failures. If the Device has failed during the base warranty period but has been repaired to normal working condition through the original manufacturer warranty service, it is still eligible for purchase.

Binding Rules: Strictly implement the rule that 1 Device SN Code can only be bound to 1 set of Care Service for life. Repeated purchase and overlapping of rights are not allowed. The Speediance 3-Year Care (3-year Edition) cannot be upgraded to the Speediance 4-Year Care (4-year Edition).

Non-transferability Rule: This Care Service is bound to both the Device SN Code and the Original Purchaser's user ID, and cannot be assigned, transferred, or alienated in connection with any second-hand sale, gift, lease, or other disposition of the Device, which is completely consistent with the "non-transferable" rule of the original manufacturer base warranty. In the event of any change in the ownership of the Device, the originally bound Care Service rights and interests will automatically become invalid, and we will not provide any Care Service to the subsequent holder of the Device. The statutory warranty of the Device is not restricted by this article and is automatically transferred with the ownership of the Device in accordance with the law; if you are in the Province of Quebec, relevant matters shall be implemented in accordance with the statutory provisions of the local consumer protection laws.

Purchase Channels: This Service can only be purchased through Speediance Canada's official DTC website. For Care Services purchased through non-official channels, we reserve the right to refuse to provide any services and shall not bear any refund or performance liability.

No Global Warranty Rule: This Care Service is only performed within Canada and does not provide global warranty services. For cross-regional maintenance, the user shall bear all relevant costs including tariffs, customs clearance, transportation, warehousing and other related costs, which is completely consistent with the original manufacturer base warranty policy.
4. Core Service Rights and Interests
All rights and interests under this Service are included in the Plan Price. There is no hidden deductible or basic service fee for services within the coverage scope, and the maintenance service standards are exactly the same as the original manufacturer base warranty:
4.1 Core Component Extended Warranty Service (Same Standard as Original Manufacturer Base Warranty)
The extended warranty service can only be activated and take effect after binding the order number, which will be sent to your registered email after purchase. After purchase, within the Total Coverage Period, we will provide you with maintenance service standards exactly the same as the original manufacturer base warranty, covering the following failure scenarios:

Functional failures of the Device host components including the motor, drive board, screen, mainboard, power supply, pulley sliding sleeve, casters, pedals, and bracket caused by material and workmanship defects of the product itself;
-
The following accessories are not covered by the Care extended warranty service, and only enjoy the original 1-year base warranty period. After the expiration of the original manufacturer warranty period, no free warranty service will be provided: rower, flat bench, adjustable bench, Bluetooth ring, barbell hooks, barbell shoulder pad, adjustable barbell, rowing pull rod, ankle straps, tricep rope, universal handles, ski-specific handles, smart handles, yoga mat, weightlifting belt, extension straps, accessory storage rack, ball joint, resistance rope kit.

Activation Method: Activate and take effect by binding the order number:

Open the Speediance Device terminal and log in to your purchase account;
-
Enter the page path: Home → Personal Page → System Settings → My Device → Speediance Extended Warranty Service;
-
Fill in the Speediance Care order number in this email in the activation input box;
-
Click Confirm Activation, and the page displays "Extended Warranty Service Activated", that is, the activation process is completed, and you can view the coverage period and rights status.
4.2 One-Time Free Whole Device Replacement Service (Core Right)
Within the Total Coverage Period, the user is entitled to 1 free whole device replacement service, and the two-way standard logistics costs are fully borne by Speediance; the one-time free whole device replacement is only applicable to mechanical or circuit failures.
4.2.1 Applicable Trigger Conditions (any one of which is met to take effect)

Unrepairable Device failure: complex functional failures that require in-depth overhaul of the whole device after official remote diagnosis and spare parts replacement fail to resolve;
-
High-value core component failure: simultaneous damage to multiple core components, resulting in a serious mismatch between the total maintenance cost and the value of the Device itself.
4.2.2 Inapplicable and Excluded Circumstances
-
Simple failures that can be effectively resolved through remote technical guidance or conventional parts replacement will not trigger the replacement right;
-
The whole device replacement qualification shall be finally confirmed after professional inspection and review by Speediance authorized technical engineers;
-
Damage caused by man-made damage, unauthorized disassembly and repair, unauthorized modification, maintenance by unauthorized third parties, commercial or overloaded abuse, and force majeure are not eligible for replacement service.
4.2.3 Device Replacement Rules
-
We can replace the Device for you with a device of the same specification and in normal working condition. The replacement device may be a new device or a refurbished device that meets the manufacturer's standards and has the same quality;
-
The functional specifications and hardware configuration of the replacement device are consistent with the original device;
-
Out-of-stock Alternative Solution: when the corresponding model is out of stock, the official will negotiate with the user to provide a queuing waiting or equivalent alternative solution.
4.2.4 Right Verification and Device Ownership
-
After the replacement device enters the delivery process, the 1-time replacement right is automatically verified and cannot be revoked or restored;
-
After the user signs for the replacement device, the ownership of the faulty old device is automatically transferred to Speediance, and the user must send it back in full in accordance with the official guidelines;
-
After the completion of the whole device replacement service, the "hardware replacement" right under this Plan shall be terminated. However, your other rights and interests such as Wellness+ membership rights, VIP priority customer service, and free resistance rope replacement will remain valid until the expiration of the original service period.

The replacement device provided under this Care Plan shall inherit the remaining term of the original Care Plan for its warranty period, or be provided with a ninety (90) day warranty period from the date of replacement (whichever is longer). The replacement device will not start a new original 2-year base manufacturer warranty period.
4.3 Original Resistance Rope Free Replacement Right
Within the Total Coverage Period, you can apply for 1 pair of original Speediance resistance ropes for free, and we will bear all standard logistics costs.

4.4 Wellness+ Exclusive Membership Rights
After purchase, you will receive a 1-month full-feature Wellness+ membership, including all membership functions such as customized fitness courses, personalized training plans, and exclusive training communities. The membership redemption code will be sent to your registered email after purchase, and is valid for 12 months from the date of sending (calculated from the purchase date of the Care order).
Activation Method:

The wellness+ redemption code will be sent after the order is successfully placed, marked as wellness redemption code, please keep it properly;

Activation path: Open Speediance Device terminal / Mobile APP → My → Membership Redemption → Enter the redemption code;

Click Confirm Activation, and the page displays the membership validity period and rights details, then you can unlock all membership functions.
Remarks: If you have obtained the wellness+ membership service before purchasing Care, when you redeem the complimentary 1-month wellness+ membership, the system will prompt "You are already a member and cannot redeem"; it is recommended that you redeem after the expiration of your existing wellness+ membership validity period.
4.5 VIP Fast Track Service
Within the Total Coverage Period, you will enjoy exclusive priority customer service, including:

Top-priority processing of all-channel consultation work orders;

Response within 12 hours during working hours;
-
Completion of damage assessment and issuance of solutions within 48 hours after failure report.

5. Service Application and Performance Process

Application Material Requirements: When submitting an application, you need to provide the Care purchase order number, registered user ID, and Device SN Code for us to verify your service eligibility. You must submit a performance application within 30 days after discovering the Device failure (if the application cannot be submitted on time due to force majeure, the time limit shall be calculated after the force majeure is eliminated). All performance applications must be submitted within the Total Coverage Period of this Plan, and we reserve the right to refuse to accept overdue applications. To the extent permitted by law, additional damage caused by serious delay in application will not be covered.

Initial Troubleshooting: After receiving the application, we will first identify and solve your problem through telephone, email, online chat or remote assistance, and will guide you to install software updates if necessary; if the above measures fail to solve the problem, we will issue a follow-up maintenance/replacement solution for you.

Pre-authorization Requirement: All maintenance and replacement services must be pre-authorized by us before execution. Without our authorization, you shall not return the Device by yourself or entrust a third-party organization to repair it, otherwise we reserve the right to refuse to bear the relevant costs and refuse to honor the corresponding rights.

Failure Assessment and Performance Execution:

For all failure report applications, we will complete the failure assessment within 48 hours and issue a maintenance solution for you;
-
Spare parts replacement / resistance rope application: arrange the delivery of original factory spare parts within 48 hours after passing the verification, and synchronize the logistics information; we will not be responsible for the delivery loss caused by the wrong or incomplete receiving address provided by the user;
-
Whole device replacement: arrange the delivery of the replacement device within 48 hours after passing the review, and synchronize the logistics information and the return guide of the old device.

Warranty Commitment for Repaired and Replaced Parts: According to the specific damage situation, we can provide maintenance services, including repairing defective parts or replacing them with officially certified refurbished parts of the same type. For the remaining coverage period, the replaced product or parts shall enjoy the same warranty scope as the original product.

Performance Verification Rules: After the corresponding service is completed and accepted by the user, we will synchronously verify the number of times of your corresponding rights and interests, update the service records, and all service records can be queried through official channels.
6. Coverage Scope and Exclusions
6.1 Defined Coverage Scope
This Care Service only covers the Device failures and services clearly agreed below, and demands beyond the scope are not within the performance liability, which is completely consistent with the original manufacturer base warranty policy:

Free maintenance and original spare parts replacement for functional failures of the core components of the Device caused by material and workmanship defects, mechanical wear under normal use, and electrical aging within the Total Coverage Period;
-
One-time free whole device replacement service that meets the agreed conditions, with full coverage of two-way logistics costs;
-
Free replacement right of original resistance rope within the agreed period and times;
-
Wellness+ membership rights and VIP fast track service within the agreed period.
6.2 Exclusions
In any of the following circumstances, Speediance reserves the right to refuse to provide maintenance and rights fulfillment services, and shall not bear any refund or performance liability:
6.2.1 Improper Operation and Use (Damage/Loss Caused by User's Subjective Operation Errors)

Product damage caused by non-manufacturing factors, including but not limited to damage caused by improper installation, use, disassembly, or damage caused by failure to operate the Device in accordance with official instructions and the user manual;
-
Damage caused by forced training after the parts are damaged; fault expansion and secondary/consequential damage caused by continued use of the Device without timely reporting of the fault (we will not be liable for the warranty of this part of the secondary/consequential damage);
-
Damage caused by unauthorized modification of the circuit, wrong use of charger/external power supply, or operation of the product when the battery is insufficient/defective;
-
Indirect losses caused by improper installation/disassembly of the product, such as damage to personal belongings, walls, floors, etc.
6.2.2 Unauthorized Modification and Third-Party Intervention (Damage Caused by Unauthorized Modification of the Device or Third-Party Accessories)

Damage caused by unauthorized modification, disassembly, maintenance of the product, or acceptance of technical support from non-Speediance official (such as improper operation, setting, installation by a third party);
-
Damage caused by intentional damage to the product or unauthorized modification of the product (including tampering with operating data);
-
Product damage caused by reliability/compatibility issues using unauthorized third-party parts;
-
Failure/damage of any third-party product (including third-party products integrated into the Speediance product at your request).
6.2.3 Environmental and Force Majeure (Damage Caused by External Environment, Sudden Environmental Factors, and Force Majeure Events)

Damage caused by exposure of the product to extreme environments such as high temperature and corrosion;
-
Damage caused by operating the product in an environment with electromagnetic interference or interference from other wireless devices;
-
Damage caused by force majeure events such as fire, flood, earthquake, power accident;
-
Damage caused by improper storage (such as fire, water immersion, lightning strike, etc.) or environmental factors during the storage, transportation and use of the product.
6.2.4 Normal Wear and Tear and Other Categories (Natural Wear and Tear, Scenario Violation, Non-hardware Exclusions)

Wear and tear, metal rust, performance degradation and appearance damage (including scratches, dents, plastic discoloration, etc.) caused by normal use or non-manufacturing/transportation reasons that do not affect the use;
-
Damage caused by using non-commercial products in commercial scenarios such as gyms, hotels, private training studios;
-
No warranty service will be provided if the product/part identification label is changed or deleted;
-
Various software programs pre-installed with the product and subsequently installed by yourself are not covered by the warranty.
7. Cancellation and Refund Policy
This policy complies with the relevant requirements of the federal and provincial consumer protection and extended warranty service laws of Canada. All refunds approved will be returned to your original payment account via the original payment method within 15 business days.
7.1 Value Recognition of Combined Products
Speediance Care is a value-added combined product including multiple rights and interests. For the purpose of calculating the refund, the retail value (MSRP) of each sub-right is recognized as follows (in provinces with otherwise legal provisions, we will implement in accordance with local laws):

Original Resistance Rope (physical goods): $69.99 CAD

Wellness+ Membership (digital rights): $34.99 CAD

VIP Fast Track (service rights): recognized at an annual value of $50 CAD

One-Time Free Whole Device Replacement Service: fair market value of $600-900 CAD per time
7.2 Full Refund within 60-Day Cooling-Off Period
Within 60 days from the date of purchase, if you have not activated or used any Care Service rights and interests (including but not limited to: no application for resistance rope, no activation of Wellness+ membership, no failure report or VIP consultation), you can apply for a 100% full refund without any deduction.
7.3 Pro-Rata Refund After Rights Activation or Beyond 60 Days
If you have activated/used part of the rights after purchase, or the refund application is made more than 60 days after purchase, the refund amount will be calculated according to the following formula:
Refund Formula: Refund Amount = [ (Original Care Purchase Price - Value of Consumed Rights) × (Remaining Days of Coverage Period / Total Days of Coverage Period) ] - Administrative Fee ($35)
7.4 Administrative Fee
Except for the full refund scenario, all refund applications are subject to an administrative processing fee of $35 (or 10% of the total refund amount, whichever is lower. If the law of the province where you are located has a lower limit on the administrative fee, we will implement it in accordance with the law of the province) to cover the operating costs of contract termination.
7.5 Synchronous Refund Rules for Hardware Return

If you apply for a full return and refund of the Device within the original return cooling-off period of the Device, the Care Service can apply for a full refund synchronously without any deduction;
-
If you apply for a return and refund due to product quality problems of the Device, the Care Service will calculate the refund according to the proportion of the remaining coverage days.

After the return and refund of the Device is completed, the bound Care Service rights and interests will be permanently terminated immediately.
7.6 Loss Limitation
If the calculated refund amount is negative (that is, the total value of consumed rights exceeds the purchase price), the actual refund amount will be treated as $0. We will not recover the difference exceeding the original payment amount from you.
7.7 Rules for Active Cancellation by the Brand

In the following circumstances, we will send a written notice to your registered email 30 days in advance to terminate this Plan:

Regulatory Requirements: Relevant regulatory authorities require us to cancel this Plan
-
Compliance Change: The compliance change of the performance subject of this Plan results in the inability to continue to perform the existing contract
-
Refund Settlement: In such circumstances, we will refund the amount in proportion to the remaining days of the coverage period, and deduct the value of delivered physical/digital rights (resistance rope $69.99, membership $34.99) and incurred performance fees (except in provinces where the deduction of performance application fees is prohibited by law)

If you are in the following circumstances, we have the right to immediately cancel this Plan without any refund, and require you to pay the full cost of the services already provided:

You fail to pay the payable fees related to this Plan and still fail to pay within 15 days after our written reminder
-
You seriously violate the obligations agreed in these Terms, or substantially increase the performance risk of this extended warranty service due to intentional man-made damage, unauthorized modification of the Device and other acts.
7.8 Termination of Rights After Refund
No matter what kind of refund scenario you apply for, and after the refund operation is completed, all rights and interests of the Care extended warranty service bound to your Device will be permanently terminated immediately. You will no longer be able to claim any unused extended warranty rights or submit any failure report applications for the Device in accordance with this extended warranty service. If the Device is still within the Original Manufacturer’s Base Warranty Period, you can report for repair normally through the original manufacturer warranty channel; and the rights and interests of this extended warranty service cannot be transferred, discounted, or restored.
8. User's Responsibilities and Obligations
This chapter is completely consistent with the Speediance Original Manufacturer Limited Warranty Policy:

Obligation to Read the Terms: Please carefully read all the contents of these Terms and fully understand the coverage scope, restrictions, exclusions and your obligations under this Plan.

Device Maintenance Obligation: You must use, maintain and service the Device normally in accordance with the requirements of the original manufacturer's user manual of the Device to ensure that the Device is in normal use condition.

Material Preservation Obligation: Please properly keep the order confirmation voucher of this Plan, Device purchase invoice, maintenance service records and other relevant documents, which are required to be provided when applying for services.

Data Backup Responsibility: Please back up all personal data stored in the Device in advance before sending the Device for repair. We are not responsible for data loss or leakage during the maintenance process.

Packaging Responsibility: If you need to return the Device for repair, please pack it in accordance with the official standard packaging guidelines. All liability for transportation damage caused by improper packaging shall be borne by you.

Receipt Inspection Obligation: After receiving the repaired/replaced Device, you should check the Device status within 72 hours. If no feedback is received after the time limit, the Device will be deemed intact.

Product Storage Rules: If the product cannot be delivered due to incorrect receiving address provided by you or no one to sign for it, we will store the product for free for 30 days; after the expiration, a storage fee of $30 per day will be charged. If the product still cannot be delivered after 90 days, we have the right to dispose of the product after complying with local laws and sending a final written notice. The proceeds from the disposal will be used to offset the arrears first, and the balance will be handled in accordance with legal provisions.

Compliant Use Obligation: If you use the product in violation of the official instructions and product user manual, or use the product for illegal purposes, we reserve the right to terminate the Care Service and the original manufacturer warranty service.
9. Limitation of Liability
Speediance does not provide any form of warranty other than those expressly specified in these Terms and the original manufacturer limited warranty, including any implied warranties of merchantability, fitness for a particular purpose, title or non-infringement, and any warranties arising from trade, usage or course of dealing.

Except for the mandatory non-exempt provisions of the local laws of Canada, the total cumulative performance liability of Speediance under this Care Service shall not exceed the original actual amount you paid for the purchase of the Care Service. We are only liable for the performance of the service content expressly agreed in these Terms. Any oral promises, descriptions, promotions or third-party sales commitments beyond the scope of these Terms shall not have legal binding force unless confirmed in writing with the official seal of Speediance.

For personal injury (including death) and property loss directly caused by Speediance's intentional or gross negligence, we will bear the performance liability in accordance with local laws and regulations; Speediance shall not be liable for any losses caused by the user's own fault, violation of the rules of these Terms, or the fault of a third party.

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, consequential or punitive losses, including but not limited to Device idle losses, fitness plan interruption losses, lost wages, expected income losses, goodwill losses, etc. These Terms are bound by the mandatory laws of the provinces of Canada.

Third-Party Liability Exemption: If the damage to the Device is caused by the fault of a third party, and we have provided you with free maintenance or parts replacement, you agree to cooperate with us to assign the relevant right to claim the maintenance cost to Speediance, so that we can recover the actual maintenance cost from the at-fault party.
10. Provincial Legal Compliance Statement
These Terms are governed by the federal laws of Canada and the laws of the province where your Device was originally purchased. If any provision in these Terms conflicts with the mandatory consumer protection regulations and extended warranty service related laws of the province where your Device was purchased, the conflicting provision shall be subject to the mandatory legal provisions of your province, and the remaining terms shall remain in full legal force and effect. Some provinces do not allow the limitation of implied warranties, the limitation of indirect loss compensation, and the rule of no refund after major claims, so the above relevant limitation clauses shall not take effect for users in such provinces.
11. Dispute Resolution
The dispute resolution rules of these Terms are completely consistent with the Speediance device sales and original manufacturer warranty policy:

Any dispute, claim or controversy arising from this Care Service shall first be resolved through friendly negotiation between the two parties;

If the negotiation fails, the dispute shall be submitted to the competent court in the province where your Device was originally purchased for litigation, and the substantive laws of the province where your Device was purchased shall apply (excluding the principles of conflict of laws);

For disputes with a disputed amount of less than $15,000 CAD (if you reside in the Province of Quebec) or disputes with a disputed amount not exceeding the statutory upper limit of the small claims court in your province (if you reside in other provinces outside Quebec), you may file a lawsuit in the competent Small Claims Court without prior negotiation, and we will fully cooperate with the relevant process requirements of the small claims court.
12. General Legal Provisions

Entire Agreement: These Terms, the Speediance Original Manufacturer Limited Warranty Policy, and your Order Confirmation Voucher constitute the entire agreement between you and us regarding this Care Service, and supersede all previous oral or written statements and promises. No agent has the right to modify these Terms or waive any provisions of these Terms. Additional statements without our written seal confirmation have no legal effect.

Severability: If any content of these Terms is deemed invalid, illegal or unenforceable by the relevant judicial authority, the provision shall be enforced to the maximum extent permitted by law, and the validity, legality and enforceability of the remaining terms shall not be affected in any way.

Privacy Protection: We strictly abide by the relevant laws and regulations on privacy protection in Canada, and only collect and use your personal information necessary for the performance of the Care Service. You can apply to access, correct, or delete your personal information through the official customer service channel at any time, and we will respond and process it within the statutory time limit.

Amendment of Terms: We have the right to revise these Terms according to the adjustment of laws and regulations and service resources. The revision shall only take effect for the Care Service newly purchased after the effective date of the revision, and will not affect the rights and interests of the Care Service that have been purchased and are in effect before the revision. We will not unilaterally derogate the legal rights and interests of users that have taken effect through the revision of the Terms.

Assignment of Contract: We may assign all or part of the rights and obligations under this Plan at any time. When assigning, we will send a written notice to your registered email 30 days in advance, and ensure that the assignee has the qualification and ability to perform all obligations under this Plan. You have the right to notify us in writing to terminate this Plan within 15 days after receiving the assignment notice if you have reasonable objections to the assignee, and obtain a refund in accordance with the provisions of Article 7.3 (refund rules for purchases over 60 days). After the assignment of the rights and obligations under this Plan, the new performance subject will fully inherit all the provisions of these Terms, and your guaranteed rights and interests under this Plan will not be affected in any way. You have no right to assign any rights or obligations under this Plan, which are agreed to be non-transferable in these Terms.

Force Majeure Exemption: If we are unable to perform the contract or provide services on time due to force majeure events such as earthquake, fire, flood, war, government ban, we will not bear any performance liability, but will make commercially reasonable efforts to notify you in advance and resume services as soon as possible after the end of the force majeure.
